OSHA Increases Penalties for Safety Violations

OSHA has announced the implementation of a new Severe Violator Enforcement Program and increasing civil penalty amounts. The changes are the result of a year-long OSHA study that found current assessed penalties “are too low to have an adequate deterrent effect,” according to the OSHA announcement.

BP Has a Dismal Safety Record, Do You?

ABC News published an article recently about BP’s dismal safety record, citing that OSHA statistics show BP ran up 760 "egregious, willful" safety violations, while Sunoco and Conoco-Phillips each had eight, Citgo had two and Exxon had one comparable citation.

If your facility has an aggregate storage capacity of over 1,320 gallons (including 55 gallon drums) of petroleum products, these amendments will certainly affect your facility.

Will the FTC ever enforce the Red Flags rule? A better question is why have a rule if there is no enforcement? In the ongoing saga of will they-won’t they- enforce the rule the answer is not today, not tomorrow and not until January 1, 2011 (maybe).
On May 28, 2010, the Federal Trade Commission (FTC) announced that it would suspend enforcement of the Identity Theft Red Flags Rule until January 1, 2011. The Red Flags Rule was originally set to take effect on November 1, 2008, but implementation has been delayed multiple times. The substance of the Red Flag Rule will not be changed during the delay.

New OSHA Hexavalent Chromium standard requires employers to notify employees
OSHA has confirmed the June 15, 2010, effective date of its Hexavalent Chromium standards. The new OSHA Hexavalent Chromium standard requires employers to notify employees of the results of all exposure determinations, including exposures which do not exceed the permissible exposure limit (PEL). Dealerships and body shops will want to look into this issue and determine if it pertains to their specific site and see if any further action is needed.
