Unionized Construction Employers Exempt Under PAGA

Effective Date: Applies to all valid collective bargaining agreements in effect anytime before January 1, 2025.

The Labor Code Private Attorney’s General Act (PAGA) of 2004 increased litigation for California employers. The Act states that employees can bring a suit against their employer to recover civil damages imposed by the Labor and Workforce Development Agency. The California Conference of Carpenters backed Assembly Bill 1654, which Governor Brown signed into law last month. It adds exemptions to PAGA for the construction industry because of the increasing number of frivolous lawsuits. However, the stipulation with the PAGA amendment is that only unionized construction employees are exempt from PAGA regulations.
